The Closest Race In the Country Still Hasn’t Been Called And Now It’s Up To The Court

In Upstate New York’s 22nd Congressional disstrict, Claudia Tenney and Anthony Brindisi are in a dead heat four weeks after election day.

Currently, Republican Claudia Tenney leads the district by 12 VOTES.

It’s a close one.

And now, the race is likely to be decided by the courts.

According to Syracuse.com “State Supreme Court Justice Scott J. DelConte ordered the counties to provide final counts by 4 p.m. of votes cast on Election Day, during early voting at polling sites, and by absentee, military and affidavit ballots.”

They note that “DelConte had ordered election officials to count at least 270 challenged absentee ballots, pending review. But more than 2,200 affidavit ballots jointly rejected by Democratic and Republican commissioners in each of the eight counties were not counted.”

Both Tenney and Brindisi maintain that they are, in fact, the winner of the race.

Judge DelConte has demanded that each campaign submit written arguments over how to handle disputed absentee and affidavit ballots by 4 p.m. on December 2nd.

He has also scheduled a public hearing on December 7th.

Claudia Tenney previously won the district in 2016, while Anthony Brindisi won in in 2018.
